NAUTILUSCD TERMS AND CONDITIONS
USING ANY NAUTILUSCD DISC INDICATES YOUR ACCEPTANCE OF THE
TERMS AND CONDITIONS.
RETURN POLICY -- If a NautilusCD disc is found to be damaged or inoperable
upon receipt, you may return that disc to METATEC Corporation for a
replacement disc, provided that the damaged or inoperable disc is received by
METATEC Corporation at 7001 Metatec Boulevard, Dublin, Ohio 43017 within
30 days following your receipt of that disc. This constitutes your sole remedy
and METATEC Corporation's sole obligation to you with respect to any
damaged or inoperable discs.
NON-RECEIPT / MISSED DELIVERY -- In the event an issue does not arrive,
replacement issues will be sent at no charge provided the replacement request is
received within 30 days of the intended delivery date. Replacement requests
received past 30 days of the intended delivery date may be subject to a charge.
SUBSCRIPTION CANCELLATION / REFUND POLICY -- Subsciriptins may be
cancelled at any time, for any reason. Cancellation requests must be received 21
days prior to the desired date of discontinuance in order to prevent additional
charges.
Refunds will be issued for any issues not shipped or not in progress. Issues may
not be returned for credit.
OWNERSHIP OF MATERIALS AND PROPRIETARY RIGHTS -- NautilusCD
ROM products are owned by METATEC Corporation and protected by
copyright law. The individual programs and products included on the
NautilusCD disc (the "Material") and all documentation accompanying the
NautilusCD disc are also protected by copyright law. Many of the Materials are
owned by third parties (the "Third Party Authors") who have provided those
Materials to METATEC Corporation for publication. METATEC Corporation
makes no claim of ownership of those Materials and has not verified the
ownership or accuracy of any of those Materials.
You are licensed to use the Material only pursuant to these terms and conditions
and any additional terms and conditions included on the NautilusCD disc with
respect to the various Materials. You may be permitted to copy all or part of
certain Materials for your use. However, reproduction of any NautilusCD disc
in its entirety is prohibited, and you must include the copyright notices on each
copy of any Material or portion thereof which you make. You may use the
NautilusCD disc only on one computer at one time.
ò If a Material is designated as "Free Use", it means that you are granted a non-
exclusive,non-assignable, and non-transferable license to use the
Material free of any additional usage fee or licensing charge for personal,
business or production use so long as the Material is not used for
commercial or resale purposes. Any commercial use requires permission from
the author.
ò If a Material is designated as "Demo/Promo", it means that the Material is
intended for demonstration or review purposes only and is not to be
used for any purpose other than evaluation of the Material.
ò If a Material is designated as "Shareware", it means that you are entitled to use
that Material on a trial basis only. If your use of the Material
exceeds the time period set forth in the terms and conditions accompanying the
Material, you are obligated to forward the indicated Shareware
payment to the author of the Material.
Except as otherwise expressly permitted by these terms and conditions or any
other terms and conditions included on the NautilusCD disc, you may not use,
sublicense, rent, lease, sell, transfer, disclose, publish, or copy the NautilusCD
disc, the Materials, or any related documentation. METATEC Corporation and
the authors retain all rights and interests not expressly granted to you.
WARRANTY DISCLAIMER AND LIMITATION OF LIABILITY -- SUBJECT TO
ANY WARRANTY OR DISCLAIMER MADE BY ANY THIRD PARTY
AUTHOR ON ITS OWN BEHALF, NEITHER METATEC CORPORATION NOR
ANY LICENSOR NOR ANY THIRD PARTY AUTHOR MAKES ANY
REPRESENTATIONS OR WARRANTIES, AND EACH HEREBY EXPRESSLY
DISCLAIMS ALL REPRESENTATIONS AND WARRANTIES, RELATING
DIRECTLY OR INDIRECTLY TO NAUTILUSCD, THE NAUTILUSCD DISCS,
THE MATERIALS, OR ANY RELATED DOCUMENTATION, WHETHER
EXPRESS OR IMPLIED, ORAL OR WRITTEN, OR ARISING BY USAGE OF
TRADE OR COURSE OF DEALING OR PERFORMANCE, INCLUDING
WITHOUT LIMITATION ANY WARRANTIES OF ACCURACY,
PERFORMANCE, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR
PURPOSE. EACH USER OF A MATERIAL IS RESPONSIBLE FOR
DETERMINING THE SUITABILITY OF THAT MATERIAL FOR THAT USER'S
PURPOSES. Some jurisdictions do not allow the exclusion of implied
warranties, so the above exclusion may not apply to you.
IN NO EVENT SHALL METATEC CORPORATION, ITS LICENSORS OR ANY
THIRD PARTY AUTHOR BE LIABLE FOR ANY INDIRECT, SPECIAL,
INCIDENTAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES,
INCLUDING WITHOUT LIMITATION LOSS OF DATA, INFORMATION, OR
PROFITS, EVEN IF INFORMED OF THE POSSIBILITY OF ANY OF SUCH
DAMAGES, AND WHETHER CLAIMED UNDER CONTRACT, WARRANTY,
TORT, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY. Some
jurisdictions do not allow the limitation or exclusion of incidental or
consequential damages, so the above limitation or exclusion may not apply to
you. The Third Party Authors are not employees or agents of METATEC
Corporation and have no authority, express or implied, to make any
representations or warranties or otherwise act on behalf of METATEC
Corporation. METATEC Corporation's licensor's liability to you for actual
damages from any cause whatsoever, and regardless of the form of the action
(whether in contract, tort (including negligence), product liability or otherwise),
will be limited to $50.
